1. Acceptance of Terms
By accessing or using ApptShield, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. These terms apply to all visitors, users, and others who access or use ApptShield.
2. Description of Service
ApptShield provides appointment management tools for small practices, including reminder notifications, waitlist management, open-slot recovery, and reporting. Features and availability may vary by subscription plan.
3. Account Registration
To use ApptShield, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Subscription and Billing
ApptShield offers subscription plans billed monthly. Charges are processed through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. We offer a 14-day free trial for new subscribers. After the trial, your selected plan will bill automatically unless canceled before the trial ends.
5. Acceptable Use
You agree not to use ApptShield for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. You may not attempt to gain unauthorized access to any part of the service or its related systems. You are responsible for ensuring your use of reminder and confirmation messages complies with applicable laws, including HIPAA and TCPA where relevant.
6. Data and Privacy
ApptShield processes appointment and contact data to provide the service. We do not send clinical or diagnostic information in reminders. You retain ownership of your data. Our handling of personal information is described in our Privacy Policy. By using ApptShield, you consent to the collection and use of information as outlined therein.
7. Twilio Integration
Text messaging features require you to connect your own Twilio account and phone number. You are responsible for Twilio charges, compliance with Twilio's terms, and compliance with messaging regulations. ApptShield does not assume liability for Twilio service availability or carrier delivery failures.
8. Intellectual Property
All content, features, and functionality of ApptShield, including software, text, graphics, and logos, are the exclusive property of ApptShield and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express permission.
9. Disclaimer of Warranties
ApptShield is provided on an 'as is' and 'as available' basis without warranties of any kind. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. Your use of the service is at your sole risk.
10. Limitation of Liability
To the maximum extent permitted by law, ApptShield shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the service.
11. Termination
We may suspend or terminate your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the service. Upon termination, your right to use the service will immediately cease.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the service after changes constitutes acceptance of the revised Terms. Material changes will be notified via email or through the service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
